Terms of Service

Welcome to DigitalRSVPs, operated by Party Plug LLC ("we," "us," "our"). These Terms of Service ("Terms") govern your access to and use of the DigitalRSVPs website at digitalrsvps.com and all related services.

By accessing or using DigitalRSVPs, you agree to be bound by these Terms. If you do not agree, please do not use the service.

1. Service Description

DigitalRSVPs provides a platform that allows users to:

• Create and customize beautiful digital invitations for events
• Send invitations via shareable links, email, or text
• Manage and track guest RSVPs in real time
• Collect guest preferences including meal choices, dietary restrictions, and song requests
• Send event reminders and updates to guests
• View analytics on invitation opens, clicks, and responses

2. Accounts

2.1 Account Creation

You may browse templates and preview the platform without an account. To save events, send invitations, and access the dashboard, you must create an account by providing a valid email address and password (or using a third-party login such as Google).

2.2 Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to notify us immediately at support@digitalrsvps.com if you suspect unauthorized access.

2.3 Age Requirement

You must be at least 13 years old to create an account. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf.

3. Pricing & Payments

3.1 Free Tier

DigitalRSVPs offers a free tier that includes access to templates, unlimited guests, RSVP tracking, and a shareable event page. Free invitations include DigitalRSVPs branding.

3.2 Premium ($9/event)

A one-time payment of $9 per event unlocks premium templates, envelope animations, branding removal, meal preference tracking, +1 management, smart reminders, Apple Music song search integration, two-way guest messaging, direct invite sending, and priority support. Premium purchases are non-refundable once the event has been published.

3.3 Pro ($19/month)

A monthly subscription at $19/month that includes everything in Premium plus unlimited events, custom branding, analytics dashboard, seating chart integration, custom domain, API access, and white-label invitations. You may cancel your Pro subscription at any time; access continues through the end of the billing cycle.

3.4 Payment Processing

All payments are processed by Stripe, Inc. By making a purchase, you also agree to Stripe's Terms of Service. We do not store your credit card details. Stripe is PCI DSS compliant.

3.5 Refunds

Premium event purchases are refundable within 7 days of purchase if the event has not been published. Pro subscriptions are non-refundable for partial months. Contact support@digitalrsvps.com for refund requests.

4. User Content

4.1 Ownership

You retain full ownership of all content you create on DigitalRSVPs, including invitation designs, event details, guest lists, photos, and text. We claim no intellectual property rights over your content.

4.2 License to Us

By uploading content, you grant us a limited, non-exclusive, royalty-free license to host, display, and transmit your content solely as needed to provide our services (e.g., rendering your invitation, sending emails to your guests). This license terminates when you delete your content or account.

4.3 Content Responsibility

You are solely responsible for the content of your invitations and events. You agree not to create invitations that contain false, misleading, defamatory, or unlawful content.

5. Acceptable Use

You agree not to use DigitalRSVPs to:

• Send spam, unsolicited bulk messages, or phishing communications
• Upload or transmit malware, viruses, or other harmful code
• Impersonate any person or entity
• Harass, abuse, or threaten others
• Create invitations for illegal activities or events
• Violate the intellectual property rights of any third party
• Attempt to gain unauthorized access to our systems or other users' accounts
• Scrape, mine, or otherwise extract data from our platform
• Use the service for any commercial spam or unsolicited advertising
• Circumvent or disable any security features

We reserve the right to suspend or terminate accounts that violate these rules without prior notice.

6. Intellectual Property

DigitalRSVPs, including its logo, design, templates, code, and written content, is owned by Party Plug LLC and protected by applicable copyright, trademark, and intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our proprietary materials.

Our templates are licensed for use within the DigitalRSVPs platform only. You may not download, redistribute, or resell template designs.

7. Blog & Affiliate Content

Our blog provides event planning tips, guides, and inspiration. Blog content may include affiliate links to third-party products or services. If you click an affiliate link and make a purchase, we may earn a commission at no additional cost to you. Affiliate relationships do not influence our editorial content or recommendations.

Blog content is provided for informational purposes only and should not be construed as professional event planning, legal, or financial advice.

8. Third-Party Services

DigitalRSVPs uses Stripe for payment processing. Your use of Stripe is subject to their terms and privacy policy. We are not liable for any issues arising from third-party service providers.

9. AI-Generated Invitations

DigitalRSVPs offers AI-powered invitation generation features. The following terms apply to your use of these features:

9.1 Ownership of Inputs and Outputs

You represent and warrant that you own or have the necessary licenses for all prompts, images, or data you upload ("Input"). To the extent permitted by law, DigitalRSVPs assigns to you all rights, title, and interest in the images generated by the service ("Output").

Note: Under current U.S. Copyright Office guidance, purely AI-generated content may not be eligible for copyright protection.

9.2 Prohibited Content & Infringement

You agree not to use the AI generation features to create content that infringes upon any third-party intellectual property rights, including copyrights, trademarks, or rights of publicity. Using the name of a protected character, brand, or living artist to circumvent safety filters is a violation of these Terms.

9.3 User Indemnification for AI Content

You agree to indemnify, defend, and hold harmless DigitalRSVPs and its officers from any claims, damages, or legal fees arising out of your use of AI-generated content, including any claims that the Output infringes the intellectual property rights of a third party.

9.4 Content Provenance

In compliance with the AI Transparency Act of 2026, all AI-generated Outputs may contain invisible metadata or watermarks (C2PA) identifying the content as AI-generated. You agree not to remove, alter, or obscure these identifiers.

10. Availability & Modifications

We strive for high uptime but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the service at any time. For material changes that affect your existing events, we will provide reasonable advance notice via email.

11. Event Data Accuracy & User Responsibility

11.1 Time Zone & Date Display

DigitalRSVPs displays event times based on the information you provide during event creation. You are solely responsible for verifying that event times, dates, and locations are displayed correctly on your invitation before sharing it with guests. We recommend previewing and testing your invitation thoroughly before publishing.

Time zone conversions, daylight saving transitions, and browser/device settings may affect how times appear to different guests. DigitalRSVPs is not responsible for any confusion, missed events, or travel costs arising from time display discrepancies.

11.2 Email Delivery

While we strive to deliver all invitation and RSVP notification emails promptly, email delivery depends on factors outside our control including recipient email providers, spam filters, and network conditions. We do not guarantee email delivery and recommend using multiple communication methods for important events.

11.3 No Guarantee of Accuracy

You acknowledge that software may contain bugs and that service interruptions may occur. DigitalRSVPs is not liable for any direct, indirect, incidental, or consequential damages resulting from display errors, data loss, service outages, or technical malfunctions, including but not limited to:

• Guests arriving at incorrect times due to time display issues
• Missed RSVPs or RSVP notification failures
• Event data corruption or loss
• Temporary service unavailability
• Errors in guest counts or meal preference tallies

Your sole remedy for any such issues is a refund of fees paid for the affected event (for Premium) or a prorated credit for affected subscription period (for Pro).

12. Termination

11.1 By You

You may delete your account at any time through your dashboard settings or by contacting us at support@digitalrsvps.com. Upon deletion, your events, guest lists, and personal data will be removed within 30 days, subject to our data retention obligations.

11.2 By Us

We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or fail to pay for premium services. We will attempt to provide notice before termination except in cases of egregious violations.

13. Disclaimer of Warranties

DigitalRSVPs is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that (a) the service will be uninterrupted or error-free, (b) the results obtained from the service will be accurate, or (c) any defects will be corrected.

14. Limitation of Liability

To the fullest extent permitted by law, Party Plug LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of DigitalRSVPs, including but not limited to loss of data, loss of profits, or interruption of business.

Our total liability for any claim arising from these Terms or the use of the service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

15. Indemnification

You agree to indemnify, defend, and hold harmless Party Plug LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from: (a) your use of DigitalRSVPs, (b) content you create or share, (c) your violation of these Terms, or (d) your violation of any rights of a third party.

16. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved exclusively in the state or federal courts located in Clark County, Nevada. You consent to the personal jurisdiction of such courts.

17. Dispute Resolution

Before filing any formal legal claim, you agree to attempt to resolve disputes informally by contacting us at support@digitalrsvps.com. We will work in good faith to resolve the dispute within 30 days. If informal resolution fails, either party may pursue formal legal proceedings as described in Section 16.

18. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top and, for material changes, notify you by email or a prominent notice on the site. Your continued use of DigitalRSVPs after changes take effect constitutes acceptance of the revised Terms.

19. Miscellaneous

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Party Plug LLC regarding DigitalRSVPs.
• Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
• Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right.
• Assignment: You may not assign your rights under these Terms without our written consent. We may assign our rights freely.
